By using BreatheFirst ("the App"), you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using BreatheFirst, you confirm that you are at least 13 years old and agree to be bound by these terms.

2. Not a Medical Service

BreatheFirst provides general wellness information and tools for educational and entertainment purposes only. It is not a medical service and does not provide medical advice, diagnosis, or treatment. The Calm AI companion is an AI assistant, not a therapist or mental health professional. Do not use BreatheFirst as a substitute for professional medical or mental health care.

3. Subscriptions & Payments

• Pro and Premium subscriptions are billed on a recurring basis (monthly or yearly)
• Pro plans include a 7-day free trial; you will be charged after the trial ends unless cancelled
• You may cancel your subscription at any time through your account settings
• Refunds are not provided for partial billing periods
• Payments are processed by Stripe and subject to Stripe's terms

4. Free Tier

The free tier of BreatheFirst is available at no cost and includes breathing exercises, daily affirmations, mood check-ins, and wellness tips. We reserve the right to modify free tier features at any time.

5. Acceptable Use

You agree not to:

• Use BreatheFirst for any unlawful purpose
• Attempt to reverse engineer, hack, or disrupt the App
• Use the AI companion to generate harmful, abusive, or illegal content
• Misrepresent your identity or affiliation

6. AI Companion

The Calm AI companion is powered by Anthropic's Claude API. Responses are generated by AI and may occasionally be inaccurate or inappropriate. BreatheFirst is not responsible for reliance on AI-generated content. The AI companion is not a substitute for professional help.

7. Intellectual Property

All content, design, and code in BreatheFirst is owned by BreatheFirst or licensed to us. You may not reproduce, distribute, or create derivative works without permission.

8. Limitation of Liability

BreatheFirst is provided "as is" without warranties of any kind. To the maximum extent permitted by law, BreatheFirst shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Changes to Terms

We may update these terms at any time. Continued use of BreatheFirst after changes constitutes acceptance of the updated terms.
